Right of withdrawal

1. Scope

This page informs customers about the right of withdrawal that may apply to distance contracts.

The right of withdrawal depends in particular on the buyer’s status, the place where the contract is concluded, the type of product and the applicable legislation.

In many cases of distance sales governed by European law, consumers have a statutory withdrawal period of fourteen days. Exceptions and specific rules may apply.

Professional buyers do not automatically benefit from this right.

2. Withdrawal period

Where the statutory right of withdrawal applies to a sale of goods, the consumer generally has fourteen days from receipt of the goods to notify their decision to withdraw.

Where several goods from the same order are delivered separately, or where goods are delivered in several lots, particular rules may apply to the calculation of the period.

The exact starting point is determined in accordance with the legislation applicable to the contract concerned.

3. Exercising the right

To exercise the right of withdrawal, the customer notifies the seller of their decision by means of a clear and unambiguous statement.

4. Returning the product

Where the withdrawal is valid, the customer returns the goods or hands them over to the seller in accordance with the applicable rules.

For a bulky product, transport may require a suitable vehicle and appropriate handling equipment.

The practical arrangements, the place of return and any costs are determined in accordance with the applicable law and the information provided before the sale.

Where the consumer is legally required to bear the direct cost of returning the goods, they were informed of this before the contract was concluded. The particular rules applicable to goods that cannot normally be returned by post are also respected.

5. Refund

Where the withdrawal is valid, the seller refunds the sums due within the time limits and in the manner provided by law.

For sales of goods, the seller may, under the conditions provided by law, delay the refund until the goods have been recovered or until proof of their dispatch has been received.

Any deductions linked to a reduction in the value of the goods may be applied only if the legal conditions are met.

6. Exceptions

The right of withdrawal may be excluded or adapted in certain cases provided by law.

Whether an exception exists is checked for the contract concerned. A general exclusion covering all used products is not published without a legal basis.
